One witness says one thing happened; another witness’s account directly contradicts the first witness. Both sides try to show their witnesses are telling the truth, while the other side’s witnesses are either wrong, confused or flat-out lying.

These he-said, she-said battles might not be completely avoidable, but stronger cases are made in court when one side can produce photographs, video, audio or other documentary evidence that cannot, by its nature, lie. We live in an age of constant connectivity. Nearly everyone has a phone with a built-in camera, video recorder or both.

When we encounter misfortune, we can use the tools we have at our disposal to document the misfortune and to hold the people responsible for our injuries accountable. That said, if you are injured in an accident, the key to winning your case might be in your back pocket.

Car accidents on busy roadways are quickly swept aside to allow traffic to flow. Before a careless driver can get his car out of the roadway and change his story about what happened, take photographs of your car and the other driver’s car. Document as much of the facts as you can, while you have the chance.

In one case discussed in Legal Matters, a worker was injured when he fell through stairs negligently installed by a contractor. Before his case came on for trial, the contractor removed the faulty steps and replaced them. He didn’t know that way back on the night of the worker’s injury, when the worker’s wife went to retrieve the worker’s tools, she had taken photos of the faulty steps on her phone. Those photos became the key evidence in the worker’s fight for justice.

We also detail a California case involving “negligent parking” by a tractor-trailer operator in California. A jury in that state found a driver negligent for parking on the interstate in a non-emergency situation. A driver who slammed into the rear of the parked rig was killed instantly.

Along the same lines, we detail the expanding list of vehicles recalled by General Motors due to faulty ignition switches. So far, at least nineteen deaths have been attributed to the problem, although consumer groups allege that as many as 300 deaths may have resulted from crashes involving the ignition switches.
