Charlotte Personal Injury Attorney Matt Arnold answers the question: “Are the laws or rules applying to a wrongful death claim different from a personal injury not involving death?”
A car accident came to a tragic end when a vehicle had to swerve to avoid an oncoming vehicle, but ended up plunging off of a bridge and into a creek, according to WSOC TV. A 17-year-old died at the scene of the accident when the vehicle he was a passenger in was trying to avoid crashing into another vehicle on the road. First responders reported that the vehicle flipped over a bridge and landed upside down in the creek below.
The driver of the vehicle, a 19-year-old, was able to crawl away from the car and walk to a nearby house for help. Nearby neighbors took the driver in and went to try and help the passenger stuck in the vehicle. However, the 17-year-old passenger was dead at the scene. The second driver involved in this accident has yet to be located.
This accident happened in Catawba County between 16th Street NE and Spring Road. Local residents report that this is not the only deadly crash that has occurred on this road. A local resident insists that guardrails need to be put up so that drivers would hit those instead of landing in the creek.
Unfortunately, the above story is not uncommon. Accidents happen every day and it is important that you take precautions to guard yourself against them and know what to do in the event you are in one. If you have been involved in an accident, the following are the recommended steps to take:
- Seek Medical Attention: First and foremost, seek medical attention for you or anyone involved in the accident needing it. Call an ambulance to the scene or, if you do not want immediate care, make a plan to go to a doctor as soon as possible.
- File a Police Report: North Carolina law requires that driver report accidents to law enforcement “immediately, by the quickest means of communication.” This police report will be instrumental in any subsequent legal action.
- Keep Records: Keep a record of the police report, doctors’ bills and appointments, witnesses to the accident, and any other personal record you have made in regards to the accident. At the scene of the accident, it can be extremely helpful to take photographs and notes of circumstances surrounding the accident or the causes of the accident.
- Contact an Accident Attorney: After an accident, it is important to reach out to an experienced accident attorney to help you with any claims that result from the accident.
