Can I Sue a Rideshare App?

Charlotte Personal Injury Attorney Matt Arnold answers the question: ” What should I do if I’m injured as a passenger in a car accident?”

By now, you have probably heard of various rideshare apps that allow individuals to summon a car and driver through a smartphone app to take them from place to place. Common rideshare apps include Uber and Lyft. Taking a ride through a rideshare app can be incredibly convenient. For a little money, you are able to go from Point A to Point B without having to use your own vehicle or drive through traffic. Rideshare also is a safe alternative to getting behind the wheel when you might otherwise be distracted or under the influence of an impairing substance.

Recently, a North Carolina man took the ride of his life with a Lyft driver, according to ABC6. The passenger, who has remained unidentified, was taking a Lyft when the driver started speeding in excess of 120 miles per hour. The passenger recorded the speed at approximately 130 miles per hour on his cell phone. The Lyft driver was driving so fast that a state trooper that he passed could not catch up to him at that speed. The driver was allegedly afraid of going to jail and told the passenger that he needed to go. A state trooper was not able to catch up with the driver until the passenger was already dropped off.

The Lyft driver was cited going more than double the speed limit and with reckless driving. The safety of passengers in a Lyft, Uber, or other rideshare service has come to light recently. While the passenger of this speedy Lyft was not injured during this incident, the situation could have quickly become a tragedy. If you have been injured through the use of a rideshare, you might have a personal injury claim. It is important to speak with an attorney to determine what options, if any, are available to you under the circumstances of the injury or occurrence.

Of course, there is no way to guarantee safety in every situation, but taking these precautions could help keep you safe on your rideshare journey:

  • Always check the license plate, make, model, and name of the driver against the app
  • Wait inside until the driver arrives to pick you up
  • Ask the driver what your name is (the passenger being picked up)
  • Ride in the backseat
  • Share the status of your trip with another
  • Try to take a rideshare when you are not alone
  • Keep personal information to yourself

The safety of both the driver and passenger is of the utmost importance in a rideshare transaction.
