Recovering Damages for a Hit-and-Run Injury in North Carolina

Personal injury Lawyer Matt Arnold answers the question: “I was involved in a motor vehicle accident with injuries. Do I need a lawyer?”

While any type of motor vehicle collision can be scary and traumatizing, when the other driver flees the scene, the victim is left alone and not knowing what to do. In the worst-case scenario, the victim dies, as the other party flees the scene.

North Carolina law treats hit-and-run accidents seriously. The law makes it illegal to leave the scene of a car collision. Depending on the severity of the crash and motor vehicle injuries, the fleeing driver can face serious consequences. If the crash leads to wrongful death, the driver could face jail time.

Fatal Hit-and-Run Accident on Aldi Parking Lot

A recent hit-and-run collision highlighted the barbarity of these accidents. A female pedestrian was killed after being struck by a vehicle in an Aldi parking lot in Matthews. The driver fled the scene but later contacted the police, according to WCNC.

The 79-year-old woman, who died from life-threatening injuries, was reportedly putting groceries away in the back of her car when the horrific collision occurred. Her husband was with her when the accident occurred after they exited the store at 555 West John Street.

Although the driver initially fled the Aldi parking lot, she later contacted the police department to turn herself in. Her identity was not released, and no charges were filed at the time of publication.

Investigators are still trying to determine what caused the fatal parking lot accident. The Aldi grocery store in Matthews is part of a stretch of stores that are connected to each other. There are no visible stop signs on the parking lot.

How to Recover Damages for a Hit-and-Run Injury in North Carolina?

The steps you take immediately after a hit-and-run collision are critical in the process of seeking compensation for your injury and damages. Do the following things after being struck by a driver who fled the scene:

  • Write down any information about the vehicle that hit you (model, make, license plate, color, etc.).
  • Call the police to document what happened.
  • Interview witnesses, collecting their contact information in the process.
  • Photograph the extent of your personal injury or damage to your vehicle.
  • Contact a Charlotte personal injury attorney to recover damages.

North Carolina allows hit-and-run victims to pursue compensation through the Uninsured Motorist (UM) insurance coverage. However, that process can be complicated and frustrating, as your insurance company may not be cooperative when it comes to settling your claim. That is why you should get help from a knowledgeable and experienced lawyer to avoid any unreasonable delays and maximize your recovery.
