How can I Strengthen My Car Accident Claim?

Charlotte Personal Injury Attorney Legal Briefs: What if the accident was my fault?

It is safe to say that either someone you know or you yourself have been involved in a car accident at some point. Car accidents can be anything from a minor fender bender to a multi-car pile-up on the highway. However “serious” a car accident is deemed to be, there is no way to predict the injuries that might result because of it. A “minor” accident can lead to a serious injury and a “major” accident can leave a driver or passenger with absolutely no injuries. There is just no way to predict the injury after a car accident. While you can not predict the injury that might result, you can take certain action to strengthen a personal injury claim after an accident occurs. A personal injury suit is a way to collect compensation for the damages suffered as a result of another’s negligence. Personal injury suits can be complicated and confusing, but each one can be approached with the same ideology: Strengthen your case as much as possible. A few simple actions can be the difference from being successful and unsuccessful in your claims.

Maintain Records

A personal injury suit is dependent on the evidence that is presented during the case. This evidence comes from various pieces of evidence collected after the accident:

Police Report: North Carolina law requires that accidents be reported to law enforcement. Usually, this means that law enforcement will be called to the scene of the accident to make a report. The police report will include the officers findings of the accident – the scene, the parties involved, witnesses, and any other pertinent information about the accident and its causes. This report is important in a car accident case because it is proof that an accident actually occurred and how.

Medical Records: After an accident, it is critical that you seek medical attention. Whether that is being taken away in an ambulance after an accident or following up with you doctor, a medical visit needs to occur. The premise of a personal injury claim is that there was an actual injury. Without the doctors notes, observations, and diagnosis, it is difficult to push a claim along the legal path and reach a resolution. Keep track of doctors appointments, costs, prescriptions, treatments, and any additional notes about the injury. Doctors can check for present injuries and any latent injuries.

Witness Statements

The police report will likely include any witness statements, but it is a good idea to collect witness information. A witness can give testimony of what they saw and conditions of the accident. It is important to have their contact information should their statement be needed during a case.
