A serious crash involving multiple vehicles occurred in West Charlotte. The accident happened in the early morning near Sam Wilson Road and Bedford Road, resulting in significant backups. The wreck sent two people to the hospital, one with life-threatening injuries. At least one of the vehicles appears to have sustained extreme damage. Emergency crews arrived very quickly and apparently helped extricate at least one of the injured people. According to reports, Medic transported the person with life-threatening injuries to Atrium CMC.

What Caused the Accident?

Authorities have not yet identified what caused the accident. Law enforcement and others have likely done some investigation at the scene of the crash and will continue to review information to figure out how the accident occurred. Generally, accidents may have various causes, including human error, mechanical problems, and outside or road conditions. There may be more than one cause of the crash. Police and others such as the insurance companies, often review information such as police reports, witness statements, photos, and more to determine negligence.

Negligence in Accidents

When someone is hurt in an accident, the negligent party should be responsible for paying all the expenses stemming from their injuries. North Carolina utilizes the strict contributory negligence doctrine. This means that an injured party may collect damages only when they themselves are not negligent. Therefore, it is critical that the negligent party is properly identified. In order to recover damages, you must prove negligence, which includes showing that the person had a duty of care, they breached their duty of care, and you suffered damages as a result.

Proving Negligence

In this accident, more work needs to be done to determine negligence. Generally, after review, the insurance company will ascribe a percentage of negligence to each driver. To prove negligence, you will need to gather valuable information and evidence about the accident. In some cases, accident reconstruction may be necessary to make a valid conclusion. Your attorney will help you work with the insurance company to prove negligence. If a settlement cannot be reached, you may want to take the matter to court.

Recoverable Damages

An injured party may recover damages from a negligent driver. Damages include both economic and non-economic losses. Economic losses are those that are quantifiable. These include such things as medical expenses, lost wages, and property damages. Non-economic damages are those that are more difficult to put a dollar amount on, yet they may still be substantial losses. Some non-economic damages include pain and suffering, and loss of consortium, among others. As long as you were not at all negligent, you may be able to seek damages from the negligent party.
