What Caused the Crash?
According to reports, traffic was stopped at a red light at the intersection of Oak Forest Road when a large tractor-trailer plowed into them from behind. Initial reports indicate that the truck failed to slow or stop at the light, hitting other vehicles, causing a chain-reaction accident. In all, about five vehicles were involved in the incident. Further investigation and review will determine the exact cause of the crash and establish how much fault to ascribe to each driver involved in the incident
Truck Crash Investigation
Truck accidents can be complex, and the investigations can be complicated. There are many areas of data collection for truck accidents. These are generally categorized into several kinds of evidence, including electronic data, documentation from the accident scene, and reports. Truck drivers must adhere to strict rules that require them to rest for periods of time while driving long distances. Electronic logging devices (ELDs) are mandatory devices that log driver activity. Data will show whether the driver complied with the rules and regulations that apply.
GPS data is useful in determining the exact location of the truck before the time of the crash. Most trucks also have black boxes that record important technical data such as the speed of the vehicle, braking, and other details. Documentation from the scene is essential in the investigation of a crash. The police report, witness statements, video surveillance, and other information will help to evaluate the cause of the accident. Reports such as driver history and records of truck maintenance are also necessary.
What is Contributory Negligence?
After an accident, the insurance company will review the information to determine who was at fault for the crash. North Carolina utilizes a pure contributory negligence doctrine, which means that you may only get damages for an accident as long as the other driver is 100% at fault. If you have any fault at all, you are precluded from getting compensation from the other driver. In this case, the truck driver may be at fault, however, a comprehensive investigation will provide the final answer. If you were involved in an accident, you will likely want to consult with an attorney before you talk to the insurance company. You may be owed money for your damages, which could include such things as medical bills, lost wages, and money for pain and suffering, among other things.
