Should You File an Individual Talcum Powder Lawsuit vs. Join a Class-Action Lawsuit to Sue Johnson & Johnson?

Charlotte Personal Injury Attorney Brad Smith answers the question: ” Do I have to pay a fee to meet with an attorney about my personal injury case?”

If you were diagnosed with ovarian or any other type of cancer and you believe that it was caused by your talcum powder use, contact our personal injury lawyers at Arnold & Smith, PLLC, for a free consultation.

You may be entitled to financial compensation by pursuing an individual talcum powder lawsuit or joining a class-action lawsuit against manufacturer Johnson & Johnson or another manufacturer of the talcum powder that you used.

Talcum Powder Lawsuits Against Johnson & Johnson

Johnson & Johnson is facing class-action talc powder lawsuits as well as many individual lawsuits in state courts across the United States. Lawsuits against the talcum powder manufacturer allege that its products caused cancer or an asbestos-related illness due to:

  • Exposure to talc that contains asbestos; or
  • Talcum powder was used as a feminine hygiene product.

If your attorney can prove any of these claims, you may be eligible to seek compensation from Johnson & Johnson.

Johnson & Johnson Agrees to Pay Out More Than $100 Million to Settle Talc Powder Lawsuits

In October 2020, Bloomberg reported that Johnson & Johnson agreed to pay more than $100 million to settle over 1,000 talc powder lawsuits. The settlement was the first in four years of litigation that encompassed almost 20,000 lawsuits against the manufacturer.

The plaintiffs alleged that the pharmaceutical company’s baby powder and talcum powder caused cancer. In October 2019, Johnson & Johnson recalled 33,000 bottles of its baby powder products after traces of asbestos were found in the products.

Talcum Powder and Ovarian Cancer

After studies suggested that there could be a link between the use of talcum powder and ovarian cancer, many women who were diagnosed with this type of cancer filed lawsuits against Johnson & Johnson and other manufacturers of talcum powder products.

Most of those women used talcum powder as a feminine hygiene product. Some applied the product to their underwear, while others applied it directly to their genitals. An investigative report by Reuters in 2018 showed that Johnson & Johnson knew that its baby powder product contained asbestos.

Women who used Johnson & Johnson’s talcum powder products and believed that their products were safe are now suing the company for failing to disclose cancer risks. If you have been diagnosed with ovarian cancer and you used talcum powder products, contact our personal injury lawyer at Arnold & Smith, PLLC, to determine whether you are eligible to file a lawsuit to seek compensation.

Filing an Individual Lawsuit vs. Joining a Class-Action Lawsuit

When it comes to suing Johnson & Johnson for long-term exposure to asbestos-containing talc powder, you may have to choose between:

  • Filing an individual lawsuit; and
  • Joining a class-action lawsuit.

A class-action lawsuit is when hundreds or thousands of talcum powder lawsuits are consolidated in one venue to ensure more consistency from the courts when issuing rulings. However, a plaintiff has little to no control over their case, which is why many choose to hire a lawyer to pursue an individual lawsuit. Filing an individual lawsuit allows the plaintiff to maintain control over their case and maximize their compensation.
